Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your use of the Divyagyan mobile application and the website at divyagyan.app (together, the "Service"). Divyagyan is an independent project maintained by a private developer ("we," "our," or "us") and is not, at this time, operated by a registered company. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are a minor in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service you confirm that you meet these requirements.

3. Licence to Use the Service

We grant you a personal, limited, non-exclusive, non-transferable, and revocable licence to use the Service for your own non-commercial, educational, and personal use. You agree not to copy, resell, reverse-engineer, or create derivative works from the Service except where permitted by law or by the open-source and open-data licences noted below.

4. Accounts

Some features require an account managed through Google Firebase Authentication. You are responsible for maintaining the security of your account and for activity that occurs under it. Notify us promptly of any unauthorized use.

5. Acceptable Use

When using the Service, you agree not to:

• Submit false, misleading, malicious, or spam contributions to the community map or telemetry features.
• Harass, threaten, or harm others, or post unlawful, offensive, or infringing content.
• Attempt to disrupt, overload, scrape, or gain unauthorized access to the Service or its providers.
• Use the Service to violate any applicable law or the rights of others.

We may suspend or terminate access for conduct that violates these Terms.

6. Community Contributions

The Service lets users contribute information such as temple details, wait-time reports, and safety notes (the "Living Sacred Map"). You are solely responsible for what you submit and confirm you have the right to share it. By submitting, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, adapt, and share that content within the Service so it is useful to others.

Community contributions are provided by users and are not verified by us. We may edit or remove contributions at our discretion but are not obligated to monitor them, and we do not warrant their accuracy. Use your own judgement, especially for travel, timing, and safety decisions.

7. Virtual Items & Gamification

Divyagyan includes gamified elements to encourage learning. You acknowledge and agree that:

• Gyan XP (Experience Points): an internal measure of study progress and rank. It has no commercial value and cannot be purchased, transferred, or exchanged.
• Ladoo Tokens (virtual Prasad): in-app rewards used to unlock certain content. They are digital game items only.
• No monetary value: Gyan XP and Ladoo Tokens hold no real-world monetary value, carry no cryptocurrency or asset backing, and cannot be traded, sold, redeemed, or exchanged for cash, goods, or services. Attempting to buy or sell them outside the Service is prohibited and may result in account termination.

8. Intellectual Property & Open Licences

Original text, illustrations, video, and code in the Service are owned by us or our licensors. We also incorporate open data and open-source content under their respective licences:

• Map data: provided by OpenStreetMap contributors under the Open Database Licence (ODbL).
• Scripture texts & translations: sourced under Creative Commons Attribution-ShareAlike 4.0 (CC BY-SA 4.0), the MIT Licence, or the public domain.

9. Third-Party Services

The Service depends on third-party providers, including Google (Firebase and the Gemini API), Bunny.net, and OpenStreetMap. Your use of features powered by these providers may also be subject to their terms and policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

The Service, including all scripture interpretations, AI responses, timing calculations, and community content, is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or accurate. Content is provided for educational, historical, and cultural purposes and is not religious, professional, legal, medical, or safety advice.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service, reliance on its content, travel undertaken, or community contributions. Where liability cannot be excluded, it is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your misuse of the Service, your contributions, or your violation of these Terms or the rights of others.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.

14. Changes to the Service & Terms

We may modify the Service or these Terms from time to time. When we update these Terms we will revise the "Last Updated" date above. Continued use after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a mandatory law of your country of residence applies. Nothing in these Terms limits any non-waivable consumer rights you may have under local law.
